Iaas.org.sg is a website managed and administered by the International Association of Agricultural Sustainability (IAAS), a non-profit organization under the laws of Singapore, (“IAAS,” “we,” “us” etc.). These Terms of Use (“Terms”) are an agreement between the Association and you and govern your use of the Site (as defined below) and all information on or submitted through it.

IAAS provide different services and some of the services will have a specific term of use indicated, in which case your access to such Materials shall be governed by these Terms, subject to such specific terms of use.

By using this website indicates that you understand that your use of the site, registration on the site or use of any other associated website, mobile app, online portal, electronic forms, surveys and interactive exhibits managed by the International Association of Agricultural Sustainability (collectively the “Site”), constitutes your agreement to these terms, including but not limited to the Association’s Privacy Policy as amended from time to time.

Do not use the Site if you do not agree to the Terms and we encourage you to periodically review these Terms of Use to keep up to date on how we conducting your personal information. 

References to “you” means both: (1) any corporate or individual, (2) the “user” individually unless otherwise stated on the Site or in these Terms.

1. Restrictions on Use of Content

The Site contains a variety of information, including (without limitation) information, data, text, software, music, sound, photographs, graphics, video, messages or other materials, that we or you upload, post or otherwise provide in connection with the Site (“Content”). Much of the Content on the Site is not available for downloading, such as our copyrighted works that we do not distribute or works of others that we are not permitted to distribute. However, we also may have Content that designated for promoting campaigns that may be downloaded by you under these Terms (“Campaign material”). YOU MAY REVIEW, DOWNLOAD, COPY, DISTRIBUTE AND USE THE CAMPAIGN MATERIAL SOLELY TO FURTHER YOUR MISSION IN THE ORDINARY COURSE OF YOUR ORGANIZATION OR EVENT PURPOSE AND ATTENDANT OPERATIONS. YOU MAY NOT SELL THE CAMPAIGN MATERIAL OR OTHERWISE DISTRIBUTE IT FOR A FEE. 

2. Registration and Creating Profiles

Our service is membership-based, hence, we collected personal information for membership service and maintenance purpose. Completion of the process will usually create an account with a user name and password or other identifiers which you agree to guard as confidential information. 

You agree to provide accurate, current and complete information at all times. You also agree that you will review, maintain, correct, and update the membership information regularly to maintain its accuracy and completeness by using the means allowed for the relevant information or, when appropriate, by contacting us. If you provide (or the Association has reasonable grounds to believe that you provided) any information that is inaccurate, not current, or incomplete, the Foundation may suspend or terminate your access, application, grant or participation in a program, in addition to exercising all rights and remedies allowed by law.

Registration and application for an event should be completed on your own behalf. Registration and application on someone’s behalf required a writing notice by email or other methods as based. 

3. User-Provided Content

Your Responsibility and authority to others. Except for essential information for membership and event application, you may also wish to submit or upload content associated with our events or projects. When you provide content, document, media or any other forms of materials, you:  

  • Represent and guarantee that the Content is (a) fully your original works, or (b) that you obtain the necessary right, title, interest and authority to upload and present it
  • Guarantee the upload or submit content follow these terms without (i) violation of any applicable condition, restriction or law, or (ii) a potentially adverse consequence to us, Third Parties or others
  • Confirm the submitted content do not publish at the Third parties  

In addition to the condition stated above, you also acknowledge and agree that we may keep and use the content for purposes: (a) follow the legal process; (b) implement these terms; (c) respond to claims that any Content violates the right of third parties; (d) while no obligation to conduct, protect the rights, property, or personal safety of the Association (us), its users and the public.

You agree not to upload or transmit through the Site any Content or any other materials whatsoever that are or could appear to:

(i) be derogatory, obscene, invasive to another person’s privacy or protected data, or tortious; (ii) be infringing upon anyone’s intellectual property rights, including any patent, trademark, trade secret, copyright, or right of publicity; (iii) contain any software viruses or any other harmful computer code, files, or programs, including any designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment; and (iv) in violation of any applicable license, law or contractual or fiduciary duty or provision (including by exercise of the rights you grant to the Association (us) above).

We anticipate that substantial Content or even assistance will be made available to you and others through the Site or otherwise. Content may be outdated or contain typographical errors, inaccuracies, omissions, or problematic or defective functionality, and assistance will need your review. YOU AGREE NOT TO RELY ON CONTENT OR ASSISTANCE AND TO DETERMINE ALL RELEVANT FACTORS ON YOUR OWN, INCLUDING (WITHOUT LIMITATION) ACCURACY, FUNCTIONALITY, QUALITY, RELIABILITY AND OTHER RELEVANT FACTORS. We reserve the right to monitor and exercise all other rights of ours, and also to modify or remove any Content or assistance at any time, but do not obsess the obligation to do so.

Any opinions, advice, statements, assistance, services, offers, or information expressed or made available by third parties, including users, are those of the respective author(s) or distributor(s) and not of the Association (us).

4. Site Activities

The Site is provided as-is and when available, and we may change all Content, functionality and services in our discretion at any time. We may also do this for particular activities or events even if you have started to participate. If any changes occurred after your application or involvement infringe on your right. You reserve the right for a refund or compensatory. For example, we may change the event content or description at any time even if you have already applied, and not all content will be posted on the Site as we use different methods for pursuing our mission and they are not limited to the Site. 

Moreover, we or Third Parties might make a mistake and we reserve the right to correct anything, including but not limited to Content or assistance on the Site. For example, we may amend, change, withdraw or any other actions with an internship description even if you have already taken action based on it.

5. Commission

We do not want to deal with persons desiring to be paid for something unless we intentionally enter into a designated contract. This means, for example, that we do not pay commissions or other sums to anyone who helps register an event, grant or anything else unless we have expressly contracted to do so in writing prior to any such arrangement.

6. Privacy Notice. 

Our Privacy Notice is part of these Terms and is incorporated herein. Do not provide personal data about others unless you are authorized or required to do so by contract or applicable law. You may provide personal data on behalf of another person if you have provided them with a copy of this notice and any applicable supplemental privacy notice, and obtained their explicit consent. We may ask you to provide evidence of that notice and consent.

7. Violation of Our Rights or the Rights of Others; Your Warranty.  

Our Site, including the Content, is protected by Singapore intellectual property (IP) laws and you agree to respect and follow the terms:

– Our Trademarks: Owned by the Association (us).

– Other trademarks: The trademarks used in the Site are owned by (1) the organization or (2) their respective trademark owners, and are either trademarks or registered trademarks of the organization. The names of actual companies and products mentioned in the Site may be the trademarks of their respective owners. You may not use any of the above or other trademarks displayed on this Site or in any Content. All rights are reserved.

– Copyright Ownership: Copyright 2018-2021 International Association of Agricultural Sustainability or its affiliates and suppliers. All rights reserved.

All Services provided on the Site and any services or Content provided on any related site owned, operated, licensed or controlled by the Association are subject to intellectual property rights, contractual and other protections. The intellectual property rights are owned by the Association (us) or third parties (our member) and their licensors (which may include you). Except for Available Content (campaign material) or Content that you own, no Content may be copied, distributed, republished, uploaded, posted or transmitted in any way except according to the express provisions of the Terms or with the prior non-electronic consent of the Association (us) or its designee. Modification or use of the Available Content for any other purpose may violate intellectual property rights. No title to copies or to intellectual property rights are transferred to users—all title and rights remain with the Association (us).

– Campaign Material: We may provide campaign materials (banner, graphic, infographic or videos) for pursuing our mission or promoting events on the Site. Those material are available to download, copy and transmitted, but modified for promotion purpose on any platforms.

All rights not expressly granted to you are reserved. As for intellectual property rights of others, anyone who believes that their work has been infringed may provide a notice to IAAS Secretariat office by email: service@iaas.org.sg

It is our policy to terminate in appropriate circumstances any (if any) account or right of access for repeated infringement, and we also reserve the right to terminate for even one infringement.

8. Amendments

You agree that from time to time we may alter (including adding or eliminating all or parts of provisions) these Terms, including but not limited to the Privacy Notice (“Amendments”). Amended versions of these Terms will take effect on the date specified for the amended version (“Effective Date”) and will apply to all information that was collected before or after the Effective Date, including information in databases. You have no continuing right to use the Site. You will be subject to the version of the Terms in effect on your visit. Those terms will change from time to time and the changes will be effective when they appear in a replacement version of these Terms as posted by us on the Site. No other Amendments will be valid unless they are an agreement made by us and by you.

Each time you return to the Site, you are responsible for checking the effective date of the then-posted version of these Terms—if it is later than the date of the version last reviewed, the Terms have been changed and the new version should be reviewed before using the Site. USE OF THE SITE AFTER THE EFFECTIVE DATE WILL CONSTITUTE YOUR CONSENT TO THE AMENDMENTS, SO IF YOU DO NOT WANT TO BE BOUND BY AN AMENDED VERSION, DO NOT USE THE SITE AND CEASE ALL USE OF THE CONTENT OR SERVICES.

9. Governing Law and Exclusive Jurisdiction

These Terms and your use of the Site are governed by the laws of Singapore, without regard to its choice of law provisions, except where you are required by published governmental law, ordinance, regulation, directive or order to contract for application of the law of your local jurisdiction.

10. Legal and Other Notices or Disclosures.  

Notice to You: You agree that we may give all notices we are required to give you by posting a notice on the Site or, if we have your email address, by sending a notice by email at our discretion, including (without limitation), disclosures that we are required to give you, legal notices, notices of subpoenas or other legal processes (if any), and all other communications. When we communicate by email, we may use any email address you provide when communicating with us or that we otherwise have in our records, so only supply to us an email address at which you are willing to receive all communications, including “legal” or potentially sensitive communications such as information about a job or grant application. You agree to check for notices posted on the Site.
